90-Day Waiting Period Update for 2016 Renewals (1-150 Groups): Substantive Eligibility Statement

As a reminder, the Affordable Care Act (ACA) established rules around waiting periods for employees eligible for group coverage. As part of those rules, employers must indicate if they require any additional conditions beyond the 90-day waiting period, before an employee is eligible for benefits. This applies to 1-150 groups.

These conditions are called substantive eligibility criteria, and could include such requirements as a mandatory orientation period, hours of service requirement or other criteria.

In order to meet reporting requirements, we will be sending a brief Substantive Eligibility Statement electronically to groups before renewal. The statement will ask groups to confirm if they impose any of these criteria.

The statement will be sent to groups according to renewal date. Groups with January renewals can expect the statement via email the week of Nov. 1, 2015.

All groups must complete the statement to meet reporting requirements
